FAQs Pertaining to Application for Foreigner’s Work Permit

1. What application procedures shall be performed by foreigners in order to be granted permission to work in Nanjing?

A: In order to be granted permission to work in Nanjing, a foreigner should go through the following procedures:

1Apply for a job and sign an employment contract.

2Log into the Service System for Foreigners Working in China (http://fwp.safea.gov.cn/) to register for an account. Upon submitting registration information, the employer should bring the original and copies of required materials to Windows A314 and A315, 1/F, the Nanjing Municipal Government Service Center, No.265 Jiangdong Middle Road, Jianye District, for real-name registration.

3Apply for a Notice of Work Permit for Foreigners on behalf of the foreigner.

4When the Notice of Work Permit for Foreignersis issued, the employer should assist the foreigner to apply for awork visasto the Chinese diplomatic and consular mission.

5Apply for a Work Permit for Foreigners , within 15 days of entry into the People's Republic of China holding a work visa.

6Apply for a work-type residence permit for the foreigner, within 30 days of entry into the People's Republic of China holding a work visa.

2. What materials shall an employer submit to apply for the Work Permit for Foreigners for a foreigner it wants to employ?

(1) Application Form for Work Permit for Foreigners Coming to China. This form must be printed online through the application system, signed by the applicant and affixed the common seal by the employer.

(2) Working experience certificate. The former employer of the applicant must issue a working experience certificate related to the applicant’s engagement in the current target position, including position, seniority or previous project record, and the certificate must be affixed with the common seal of the former employer or signed by the head of the employer, and contain the contact information of the certifier (or contact person).

In particular, the foreign high-end talents (Category A) meeting the criteria set out in the Standard of Classification for Foreigners Working in China include (i) talents selected in the relevant domestic talent plans, (ii) talents meeting the internationally recognized professional achievement recognition standards for whom, the commitment system shall be adopted for the working experience certificate.

(3) The highest academic qualification (diplomas) certificates or related approval deed and occupational qualification certificate of the applicant.

The highest academic qualification (diplomas) certificates obtained abroad shall be certified by the Chinese diplomatic and consular mission or by the Embassy or Consulate of the country where the applicant obtained the same, or by the academic qualifications certification body in China.

If the highest academic qualification (diplomas) certificates are obtained in Hong Kong, Macao, and Taiwan (China), they shall be certified by the academic qualifications certification body in China or notarized by the notary public in the region.

If the highest academic qualification (diplomas) certificates are obtained in China, only the original academic qualification (diplomas) certificates shall be provided.

Where laws and regulations of China stipulate that prior approval shall be given by the competent industrial authorities or the applicant shall have the corresponding access-based occupational qualifications, the approval deed or occupational qualification certificate of the industrial authorities shall be provided. (For example: Chief representatives and representatives of foreign enterprises’ representative institutions and foreign nongovernment organizations in Nanjing, presidents of foreign banks, foreign physicians and foreign pilots).

In particular, the talents meeting the requirements of "foreign high-end talents (Category A)" set out in the Standard of Classification for Foreigners Working in China include, (i)talents selected in the relevant domestic talent plans; (ii) talents meeting the internationally recognized professional achievement recognition standards, (iii) foreign talents meeting the market-oriented and encouraged position demands; (iv) innovative and enterprising talents, for whom, the commitment system shall be adopted for the highest degree (diploma) certificate.

(4) The applicant's certificate of no criminal record.

The certificate of no criminal record shall be issued by the police, security, court or other departments of the applicant's country of nationality or place of regular residence and certified by the embassy or consulate abroad or foreign embassy or consulate in China. Regular residence refers to the country or region where the applicant last resided continuously for more than 1 year after leaving his/her country of nationality, excluding the territory of China. The date of issuance of the certificate of no criminal record shall be no longer than 6 months.

The certificate of no criminal record in Hong Kong, Macao, and Taiwan (China) submitted by the applicant shall be certified by the notary organ in the region.

Without the need for certification, the non-oath no criminal record issued by the diplomatic organs (including foreign embassies and consulates in China) is accepted.

The oath-like no criminal record only intended to declare no criminal offense by the applicant is denied.

The certificate of no criminal record shall be subject to the commitment system for foreign high-end talents (Category A).

(5) Certificate of Physical Examination.

Certificate of overseas personnel's physical examination records or health examination certificate verified and issued by China's inspection and quarantine institutions or the physical examination certificate of foreign health and medical institutions acknowledged by China's inspection and quarantine institutions shall be valid for 6 months since its issuance. The commitment system may be adopted before the entry, and when the applicant submits the application for the Work Permit for Foreigners after the entry, the applicant may retroactively submit the certificate of overseas personnel's physical examination records or health examination certificate verified and issued by China's inspection and quarantine institutions.

(6) Employment contract or certificate of employment (including letter of dispatch by multinational corporations).

The applicant shall submit the Chinese contract, sign it and affix the common seal of the employer. The contract shall not be altered. The employment contract or certificate of employment (including letter of dispatch by multinational corporations) shall include the necessary contents, including the place of work, content of work, remuneration, time to work in China, position and seal page (signature).

The certificate of employment is applicable to people who perform agreements or treaties between governments and international organizations, chief representatives and representatives of various foreign representative agencies in China, as well as to foreign contract service providers. If the certificate of employment (including the letter of dispatch) lacks necessary contents, a separate certificate shall be issued to supplement the information.

The letter of dispatch is applicable to managers, other senior executives and technical professionals dispatched by the headquarters or regional headquarters of multinational corporations to work at their subsidiaries or branches within China, and it shall be issued by the headquarters or regional headquarters of multinational corporations in question.

If managers, other senior executives and technical professionals are dispatched by the headquarters of multinational corporations in China to work at their subsidiaries or branches within China, the applicant shall submit the letter of dispatch and the employment contract signed with the headquarters of multinational corporations in China.

(7) The applicant’s passport or international travel certificate. The valid period of the passport shall be no shorter than 6 months.

(8) If family members come together, the applicant shall submit the following certificates for the family members coming together.

• The information pages of the passports (or international travel certificates) of the family members.

• Certificate of family relationship (spouse - marriage certificate, offspring - birth certificate or adoption certificate, parents or parents of spouse - the applicant’s birth certificate, marriage certificate or notarial certificate).

• Physical examination (family members aged above 18) and electronic photo.

Note: Chinese translations shall be provided for all materials not prepared in Chinese, except the passport or international travel certificate, and affixed with the common seal of the translation company. The originals of paper materials and Chinese translations shall be both electronically uploaded to the processing system. It is only required to provide for verification the originals of paper materials that are required for verification on the site, and no duplicates are required.

If there is a change to the nationality of a foreign applicant, the applicant shall apply for the Work Permit for Foreigners Coming to China.

3. What materials shall an employer submit to extend the Work Permit for Foreigners for a foreigner it wants to employ?

(1) Application Form for Extension of Work Permit for Foreigners Coming to China. This form must be printed online through the application system, signed by the applicant and affixed the common seal by the employer.

(2) The information page, visa page, page of proofmark stamp for the last entry, or information page of valid residence permit on the passport of the applicant.

(3) Employment Contract.

(4) Work Permit for Foreigners.

It includes the present Foreign Expert Permit or Foreigner’s Employment Permit remaining in the valid period.

Note: To extend the present Foreign Expert Permit or Foreigner’s Employment Permit remaining in the valid period, the applicant shall also provide the certificate of the highest degree and its Chinese translation (affixed with the common seal of the employer).

4. Who are foreign graduates?

Foreign graduates are divided into foreign students and foreign graduates from overseas colleges and universities, which are categorized specially as follows:

(I) Foreign students shall meet one of the following conditions:

(1) Outstanding foreign graduates who have obtained a master's degree (diploma) or above from colleges and universities in China and have graduated within 1 year, and who intend to find a job or start a business in the city.

(2) Foreign students who have obtained bachelor's degree (diploma) or above from colleges and universities in Nanjing and graduated within 1 year, and who intend to find a job or start a business in Jiangbei New Area of Nanjing and other provincial-level or higher development zones (or parks) in the city.

(3) Foreign students who have obtained bachelor's degree (diploma) from colleges and universities in Nanjing and have graduated for less than 1 year, and their employment and businesses they start in the city are in line with the catalogue of emerging industries and layouts in which the city encourages foreign investments.

(II) Foreign graduates shall meet one of the following conditions:

(1) Foreign graduates who have obtained the master’s degree (diplomas) or above from a high-level university abroad (overseas) and have graduated within 1 year, and who intend to find a job or start a business in the city.

(2) Foreign college graduates who have obtained bachelor's degrees (diploma) or above from a high-level university abroad (overseas) and have graduated within 1 year, and who intend to find a job or start a business in the Jiangbei New Area of Nanjing and other provincial or above level development zones (or parks) in the city.

(3) Foreign graduates who have obtained bachelor's degree (diploma) or above from a high-level university abroad (overseas) and have graduated within 1 year, and their employment and businesses they start in the city are in line with the catalogue of emerging industries and layouts in which the city encourages foreign investments.

The list of high-level university abroad (overseas) shall be subject to the one published by the State Bureau of Foreign Experts "Service System for Foreigners Working in China".

5. What kind of foreign graduates are eligible for the Work Permit (Category C)?

Foreign graduates shall:

(1) Be at least 18 years old, healthy, and have no criminal record.

(2) Have a valid passport.

(3) Have an average grade of not less than 80 points (percentage system, other point system converted to percentage system processing) or B+/B (grade system) or above, and have no record of bad behavior, during the school period (foreign graduates from overseas colleges and universities can be exempted).

(4) The employer shall offer him/her an annual salary not lower than the average annual salary of urban non-private sector on-the-job workers in the previous year as published by the Municipal Bureau of Statistics.

(5) Possess the corresponding academic qualification (diplomas) certificates and professional skills required for their jobs, and the jobs they are engaged in match the specialties they have studied.

(6) Other conditions stipulated by laws and regulations.

6. What documents are required for foreign college graduates to apply for the Work Permit (Category C)?

The application shall be based on the work unit, together with the following materials:

(1) Application Form for Work Permit for Foreigners Coming to China.

(2) Curriculum Vitae in Chinese.

(3) Front view photo within the last 6 months.

(4) Certificate of overseas personnel's physical examination records or health examination certificate verified and issued by China's inspection and quarantine institutions, which are valid for 6 months since its issuance.

(5) The highest academic qualification (diplomas) certificates obtained abroad shall be certified by the Chinese diplomatic and consular mission or by the Embassy or Consulate of the country where the applicant obtained the same, or by the academic qualifications certification body in China. If the highest academic qualification (diplomas) certificates are obtained in Hong Kong, Macao, and Taiwan (China), they shall be certified by the academic qualifications certification body in China or notarized by the notary public in the region. If the highest academic qualification (diplomas) certificates are obtained in China, only the academic qualification (diplomas) certificates shall be provided.

(6) Certificate of no criminal record, which shall be issued by the police, security, court or other departments of the applicant's country of nationality or place of regular residence and certified by the embassy or consulate abroad or foreign embassy or consulate in China. Regular residence refers to the country or region where the applicant last resided continuously for more than one year after leaving his/her country of nationality, excluding the territory of China. The time of issuance of the certificate of no criminal record shall be within 6 months prior to the applicant's latest entry into China.

(7) Foreign students who graduated from colleges and universities in China are also required to provide a certificate of no bad behavior record during the school period and documents proving their achievements issued by their school, stamped with the official seal of the school, and signed by the person in charge of the school as well as his/her contact telephone number.

(8) Employment contract.

(9) Information page of a valid passport, study-type residence permit or valid visa.

(10) Other supporting documents deemed necessary by the licensing authority.

7. What are the acceptance points for going through the Work Permit for Foreigners Coming to China?

Employers belonging to provinces (ministries) in Nanjing shall apply for business with the Provincial Department of Science and Technology and the business acceptance point located at Room 211, Gate 3, Science Hall, No.118 Chengxian Street, Xuanwu District, Nanjing, China, Consulting Tel: 83236029.

Municipal employers in Nanjing can apply to the Municipal Bureau of Science and Technology and the business acceptance point located at Windows A314 and A315 , 1/F, the Nanjing Municipal Government Service Center, No.265 Jiangdong Middle Road, Jianye District, Consulting Tel: 68505314, 68505315.

Employers registered in the Jiangbei New Area of Nanjing (including Nanjing Area of FTZ) shall apply for business to the Science and Technology Innovation Bureau of Jiangbei New Area of Nanjing, business acceptance point is located at Windows B17 and B22, International Talent Service Center, Public Security Hall, 3/F, Civic Center, No.292, Binjiang Avenue, Jiangbei New Area of Nanjing, Consulting Tel: 83146818.

Jiangning District Science and Technology Bureau is responsible for accepting the application materials of the registered employers in Jiangning District. (Address of the acceptance point: Window F01, 3/F, Citizen Centre, No.2 Yangjiawei Road, Jiangning District, Nanjing City, Jiangsu Province, Consulting Tel: 87180602).

Jiangning Development Zone Science and Technology Talent Bureau is responsible for accepting the application materials of registered employers in Jiangning Development Zone. (Address of the acceptance point: 1/F, Building C1, Jiulonghu International Enterprise Headquarters Park, No.19 Suyuan Avenue, Jiangning District, Nanjing, Jiangsu Province, Consulting Tel: 52110731).

The Gaochun District Science and Technology Bureau is responsible for accepting the application materials of the registered employers in Gaochun District.
